The Process to Expunge a Criminal Record
The process to expunge a criminal record in California is a short legal process that usually takes two to six months depending on the severity of the case and the Court calendar. To have a criminal conviction record can adversely affect your ability to find gainful employment, housing and credit.
The process of expungement of a record is handled by the court in which the conviction was originally handed down. A petition has to be filed with the court requesting to withdraw a plea retroactively. The petition will reopen your case for a judge's review to determine if there is 'good cause' under the law to withdraw your plea of guilty or no contest. If the judge determines there is 'good cause', the judge will dismiss your case retroactively. This will clear your conviction record.
Not all convictions can be expunged. Call the San Diego criminal attorneys at The San Diego Law Center to have your case reviewed by experienced attorneys.
