According to the state of California Vehicle Code, a vehicle is defined as an device that can be propelled, moved, or driven on a highway and is powered by human force. Driving a motorcycle under the influence of drugs or alcohol has similar penalties to drunk driving incidents involving automobiles. A motorcyclist can be charged with two separate cases involving criminal court and the California Department of Motor Vehicles (DMV). If you have been arrested for operating a motorcycle while under the influence, you must report to the DMV within 10 days of the arrest. If you fail to do so, the DMV will begin suspending your motorcycle license. Penalties for this arrest include probation, jail time, fines, DUI education classes, and license suspension. Law enforcement will test a motorcyclist’s blood alcohol concentration (BAC) with field sobriety tests and breathalyzer tests. Operating a boat while under the influence (BUI) violates the California Harbors and Navigation Code which does not allow a person to operate any boat with a BAC of .08 or higher, and .04 for commercial boats. Boating violations can result in jail time and fines.

The FAA (Federal Aviation Association) does not tolerate blood alcohol concentration higher than .04. If a pilot violates these terms, he or she can face time in prison, a voided pilot license, and fines. A pilot’s BAC will be tested with a breathalyzer test.

Cycling while under the influence of drugs and alcohol (CUI) can result in fines of about $250. The penalties for this type of arrest are less serious. California has a special law for cycling under the influence because a bicycle is not considered a vehicle according to the California Vehicle Code. However, you can still be penalized for riding a bike under the influence if you have been riding on a designated highway.
